Chris Devonshire-Ellis Speaks to Law360 about China’s BRI
Dezan Shira & Associates Founder and Chairman Chris Devonshire-Ellis recently spoke to legal intelligence firm Law360 on concerns surrounding adjudication of China’s Belt and Road Initiative (BRI).
Foreign investors have long been cautious on international dispute resolution in China due to claims of corruption, partiality, a lack of efficiency and governmental bias. But the BRI has inspired the need for international commercial courts, and the government recently established two such courts to manage international disputes, which are expected to arise from the BRI.
In response to this announcement, Devonshire-Ellis confirmed that neither of the two new courts have a history or reputation for handling international disputes, particularly of this magnitude.
Devonshire-Ellis told Law360, this reputation “…needs to be built, and there needs to be a need and international acceptance for this. That isn’t yet in place. However, China needs to build more trust on the international stage and if they can accomplish this by demonstration impartial conduct in these courts, then that must be positive.”
Whether these new courts will achieve this end remains to be seen.
